The terms and conditions of this agreement and the instructions incorporated
herein shall be legally binding and includes all "use of"

Services
1.
Experienced Technicians on Call
Applications Etc
services are
available between the hours of 9:00am to 6:00pm Monday-Friday. Weekend hours are
10:00am to 4:00pm on Saturdays.
After hour services are available by call back only. (Pacific Time) Technicians
are available and on call to assist clients with system problems on a 24 hour
basis.
Remote repair services are
available in the United States only, provided users have Internet and/or
telephone available.
2.
Payments
for services
Applications Etc
will invoice for services, onsite, telephone and remote. Acceptance
of services we provide means you are entering into a contract for services.
All services over 10 minutes (cumulative) are billable and payment is
expected upon invoice receipt.
Should any individual have any problems with the services provided, it is the
responsibility of that individual, company or representative to contact our office for resolution.
3.
Late fees and collections
Applications Etc
does apply late fees for delinquent
accounts beyond its 30 day term. These late fees are
applied at a 19.8% APR on the remaining balance from the previous posting, and applied on or about the fifth of
each month. Do to our "Term 30" grace period,
and invoicing throughout each month; initial late fees may vary because
more than 30 days may have accumulated.
Should after numerous attempts to collect delinquent balances without
notification, the
account may be placed in collections or legal action taken.
4.
Guarantee for Services Rendered
Applications Etc
guarantees
that clients receive top quality services. Many
technical problems can be resolved online. In
the cases that the problem cannot be resolved online or by telephone, our
technicians will consult with the client for an on-site solutions, if the client
is within our service area. All labor
services are warranted for thirty days.
If any hardware was required during services, defective hardware will be replaced
within thirty days at no expense.
After thirty days, any hardware replaced will be done based on the manufactures warranty.
If service have been completed and the
client is not satisfied, corrections may be made at the request of the client or the client may request a refund for services within the
warranty period.
5.
Prevention of Services
Every attempt will be made to deliver services as promised and described.
Applications Etc
cannot be held responsible for
circumstances and causes beyond its control.
Such natural or manmade disasters, malicious intent and other failures
such as; power outages, computer "hacking" attack or computer virus, technical
equipment failures, or other damage that would prevent repair would not be the responsibility of
Applications Etc
.
6.
Our Complaint Resolution Policy
Applications Etc
will respond
to billing complaint within seven business days of receipt of a written notice and
will address and attempt to resolve complaint(s) within 45 days of receipt. In the
event we cannot reach a satisfactory resolution, a third-party dispute
resolution services can be contacted by, and at the expense and responsibility of the client. Please call the contact number at the top of the invoice or

if you have any questions or concerns
in regards to the services provided.
Applications
Etc
is committed to customer satisfaction and
will take any and all necessary steps to provide you with a fair, timely and
effective resolution. All technicians' telephone and remote sessions with
clients may be recorded and monitored and all details of the service documented on
the service form for billing in case a dispute arises.
7.
Our Liability Limitations
Applications Etc
will not be
liable to any party or parties for any damages of any kind without limitations
or any resulting negligent or criminal acts.. This includes third party software
and hardware damages, and damages resulting from other third party services.
Applications Etc
will not be responsible for lost profits,
data, and down time due to failure or recovery.
Applications
Etc. and all
Applications Etc
websites, or any associated website will
not be liable for incorrect contents or information which is referenced to or by link
to
Applications Etc
or associated website through other
parties.
8.
Our Right to Refuse Services
Applications Etc
is a family
friendly service and has the right to refuse, suspend or terminate any services to any client within its sole discretion. The reasons
may include but are not limited to: using computer system fraudulently, illegally,
or for propagating libelous or otherwise defamatory, obscene, pornographic,
abusive, harassing or threatening material.
9.
Your Important Data
Your data is very important and it is your personal responsibility to protect and
back it up.
Applications Etc
will do its best to preserve but will not be liable for any data loss,
corrupted, after or during any service.

a.

retains all title and intellectual
property rights in and to all the content in the

site. Our copyright protects all the

accompanying data (together referred to as "Content") and may only be used by

the site are appropriate or available for use in other locations. If you access
